PUBLIC HEARING:

12. Public Hearing at the request of the City of Carpinteria to:

(1) Adopt modified Ordinance Nos. 788 and 789 on a revised second reading, making changes to Carpinteria Municipal Code, Title 14- Zoning, adding clarifying language to Chapter 14.04- General Provisions, Section 14.04.030 (Applicability), adding Chapter 14.19- RMU Residential/Mixed Use, and adding Chapter 14.51- Objective Design Standards;

(2) Adopt Resolution No. 6379, acknowledging receipt of, and accepting, the California Coastal Commission’s conditional certification of LCP Amendment LCP-4-CPN-24-0066-1 with suggested modifications (Chapter 14.04- General Provisions, Section 14.04.030 (Applicability), Chapter 14.19- RMU Residential/Mixed Use, and Chapter 14.51- Objective Design Standards), and directing the City Manager to transmit this Resolution to the Coastal Commission Executive Director; and

(3) Determine that none of the conditions have occurred or exist as set forth in California Environmental Quality Act ("CEQA") Guidelines section 15162 to require the preparation of a supplemental or subsequent Environmental Impact Report ("EIR") for the subject zoning amendments, and that the Addendum to the certified 2003 Program EIR satisfies the environmental review requirements of CEQA. The City Council also finds that the Coastal Commission adopted a certified regulatory program containing the necessary environmental review for the Project (Public Resources Code Section 21080.5). Finally, the City Council finds that, notwithstanding the foregoing, the approval and adoption of Ordinance Nos. 788 and 789 are exempt from review under CEQA pursuant to Public Resources Code Section 21080.9, and CEQA Guidelines Section 15265.
